The terms that govern your use of www.xeltec.com.

1. Agreement to these terms

These Terms of Use govern your use of www.xeltec.com (the “Site”), operated by Xeltec LLC (“Xeltec”, “we”, “us”), 44679 Endicott Dr Unit 438, Ashburn, VA 20147, USA.

By using the Site, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the Site.

The Site is intended for businesses and working professionals. You must be at least 18 years old to submit information through it. If you use the Site on behalf of a company, you confirm that you have authority to accept these terms for that company.

2. Our services and separate agreements

The Site describes Xeltec’s staffing and consulting services, including Workday, enterprise platform and AI talent, contract staffing, contract-to-hire, direct hire, team augmentation and partner subcontracting.

The Site is for information only. Nothing on it is an offer to provide services, an offer of employment, or a guarantee that a candidate will be placed or a role will be filled. Any engagement between Xeltec and a client, partner, candidate or consultant is governed by a separate written agreement, which takes priority over these terms.

Figures and results. Statements on the Site such as time-to-hire, matching accuracy, years of experience or network size describe our typical past performance. They are not promises about any specific engagement, and actual results vary.

We may change, suspend or remove any part of the Site or our services at any time.

3. Acceptable use

You agree not to:

  • use the Site for any unlawful, fraudulent or harmful purpose;
  • submit false or misleading information, or information about another person without their permission;
  • attempt to gain unauthorized access to the Site, its servers or any connected systems, or interfere with its security or operation;
  • upload or transmit viruses, malware or any other harmful code;
  • scrape, harvest or collect data from the Site by automated means without our written permission, including to train AI models;
  • send spam or unsolicited messages through the Site’s forms; or
  • copy, frame or mirror the Site, or use it to build a competing service.

We may restrict or block access to the Site for anyone who breaks these rules.

4. Intellectual property

The Site and its content, including text, graphics, logos, icons, page design and code, belong to Xeltec or its licensors and are protected by copyright, trademark and other laws. “Xeltec” and the Xeltec logo are trademarks of Xeltec LLC.

You may view and print pages of the Site for your own business use. You may not copy, modify, republish, distribute or sell any part of it without our written permission.

Third-party trademarks. Workday, SAP, Oracle, PeopleSoft, ServiceNow, Microsoft, AWS, Google, Amazon and other product or company names and logos shown on the Site are trademarks of their respective owners. Client logos are shown to identify organizations we have worked with. Their use does not mean these companies endorse or are affiliated with Xeltec, except where we say so expressly.

5. Information you submit

When you send us information through the Site’s forms or by email, you confirm that it is accurate and that you have the right to share it. We handle personal information as described in our Privacy Policy.

Please do not send confidential or commercially sensitive information through the Site’s forms. If you need confidentiality before sharing details, tick the NDA option on the form or ask us, and we will arrange a non-disclosure agreement. Until an NDA or other written agreement is signed, information sent through the Site is not treated as confidential, except personal information, which we always protect as our Privacy Policy describes.

6. Links to other websites

The Site may link to websites we do not control, such as LinkedIn or Instagram. We are not responsible for their content, policies or practices, and a link does not mean we endorse them.

7. Disclaimer

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, XELTEC MAKES NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS.

Content on the Site is general information about our services and industry. It is not professional, legal, HR, payroll or technical advice for your situation.

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, XELTEC AND ITS MEMBERS, OFFICERS, EMPLOYEES AND CONSULTANTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED US$100.

This section covers your use of the Site only. Liability for services we provide is governed by the separate agreement for those services. Nothing in these terms limits liability that cannot be limited under applicable law, such as liability for fraud.

9. Indemnity

You agree to indemnify and hold harmless Xeltec and its members, officers, employees and consultants from any claims, losses and costs (including reasonable legal fees) arising from your breach of these terms or your misuse of the Site.

10. Governing law and disputes

These terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to its conflict-of-law rules. Any dispute relating to the Site or these terms will be brought exclusively in the state or federal courts located in Loudoun County, Virginia, and you consent to their jurisdiction.

11. Changes to these terms

We may update these terms from time to time. The new version will be posted on this page with a new “last updated” date. By continuing to use the Site after a change, you accept the updated terms.

12. General

If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce any right is not a waiver of it. These terms, together with our Privacy Policy, are the entire agreement between you and Xeltec about the Site.
